The thing is you can't set a precedent in an employment tribunal its not a high enough court, but it would be interesting to see how they come to a decision.

Interesting debate, my only thought I have is that there is likely to be much more to this than just the linkedin post, as if the relationship was good in he first place the post would not have resulted in such a harsh response and indeed may not have been made in the first place, The trouble with cases like this is that they tend to reduce a case to one factor when the problem is actually about the fundamental relationship between the employer and employee. Notifying employees of policies and procedures and checking CV etc are eminently good ideas but probably woudln't have made any difference because the relationship was already damaged beyond repair. Mind you it makes for a good headline even if the story has been dumbed down out of all recognition!

But the point is, he is being vilified for posting his CV on the site, which others, including the manager of the process have also done. It appears that this 'new policy' at the company is not being communicated fully and across the board.
